1. Who I am

This website is run by Dom Montoya, an independent web designer and developer ("I," "me," or "my"). You can reach me at dominic@thedominicmontoya.com. By using this website or my services, you agree to these terms.

2. Information on this website

The information here is general and may change at any time. Prices, plans, and features shown on this site are not an offer or a contract. Sending the contact form does not create an agreement or obligate either of us to work together.

3. Quotes and website builds

• Every website build starts with a written quote or agreement. It lists the pages and features, the price, the payment schedule, and the expected timeline.
• Work begins after you accept the quote and pay any required deposit.
• Requests outside the agreed scope, such as new pages, redesigns, online stores, custom booking systems, customer accounts, or complex integrations, are quoted separately.
• If a signed quote or agreement says something different from these terms, the quote or agreement wins.

4. Care plans

• Every website comes with one plan: Website Hosting, Website Care, or Website Priority Care.
• Your plan starts when your website launches. You are billed every 28 days (13 billing cycles every 52 weeks).
• Included edit time resets each billing cycle and does not roll over.
• Extra routine edits cost $100 per hour, with a 30-minute minimum. I'll get your approval before starting.
• Fixing mistakes caused by my work does not use your edit time.
• Business days are Monday to Friday, not counting holidays. Support is not available 24/7. Reply and completion times start once I have everything I need from you.
• Same-day work may be possible, but it isn't guaranteed.
• You can cancel any time before your next billing date. Your plan continues until the end of the period you already paid for. Payments already made are not refunded.
• Prices do not include applicable taxes.

5. Your responsibilities

• You'll give me the text, photos, logos, and other content for your website, and you're responsible for making sure it's accurate.
• You confirm that you own the content you send me or have permission to use it.
• You're responsible for making sure your business, your website content, and your offers follow the laws that apply to you.
• Delays in getting me content, feedback, or payments may delay the project timeline.

6. Third-party services

Websites rely on outside services, like domain registrars, hosting and network providers, email providers, booking tools, and payment processors. Domain registration, business email, and paid third-party subscriptions are separate from my prices. These services have their own terms, and I'm not responsible for their outages, changes, or decisions.

7. Ownership

You keep ownership of the content you provide. Once your project is paid in full, you own the final design and content made for your website. I keep the right to reuse my general know-how, code, tools, and techniques on other projects. I may show your finished website in my portfolio unless you ask me not to.

8. No guarantees

I work hard to keep websites running well, but no website can be online 100% of the time. Uptime monitoring and backup copies help, but they don't guarantee that a site will never go down or that every file can be recovered. I also can't guarantee specific search rankings, traffic, or sales. My services are provided "as is," to the extent the law allows.

9. Limit of liability

To the fullest extent the law allows, I'm not responsible for indirect or follow-on losses, such as lost profits, lost data, or lost business. If I am found responsible for a problem, my total responsibility is limited to the amount you paid me in the three months before the problem happened.

10. Using this website

Please don't misuse this website. That includes sending spam through the contact form, trying to break or overload the site, or copying it to pass off as your own work.

11. Changes to these terms

I may update these terms from time to time. When I do, I'll change the date at the top of this page. Changes don't affect a signed quote or agreement that's already in place.

12. Governing law

These terms are governed by the laws of the State of New Mexico and applicable United States law, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in New Mexico.
